Alina Habba has resigned as the US Attorney for New Jersey. This comes after a legal ruling that questioned her eligibility to serve.

Official Departure

The head of the Justice Department, the Attorney General, accepted the prosecutor's departure on Monday. Bondi stated that the appeals court finding made it "untenable" for Habba to perform her duties.

"But do not mistake compliance for surrender," she wrote. "This battle will now reach across America."

Court Ruling

Habba's exit was triggered by a federal appellate panel ruled that she had been acting without proper authority as US attorney. This decision is expected to impact many prosecutions in New Jersey.

The judicial panel declared that a temporary posting that bypassed confirmation by the US Senate breached the Federal Vacancies Reform Act.

Future Role and Reaction

Bondi said that the former prosecutor will remain at the Department of Justice as a high-level advisor. She will pursue additional appeals of the ruling, with hopes of a overturned decision.

Writing online, the Attorney General wrote that the judiciary "should not be able to countermand the appointment of prosecutors entrusted with executing the fundamental role of the presidency of criminal prosecution."

Performance in Office

The attorney general commended Habba's record and pointed out that during her run, the Newark saw a significant drop in crime. It was also reported that the city of Camden had its initial homicide-free summer since 1974 without a homicide.

Connection to Donald Trump

The 41-year-old attorney, first joined Donald Trump's lawyers in 2021. She went on to defended the former president in his New York criminal case in 2024, when he was guilty verdict on dozens of charges of financial record manipulation.

Earlier, assuming the federal prosecutor position, Donald Trump had announced he was naming her as his senior adviser during his second administration, describing Habba as "unwavering in her loyalty" and a dedicated fighter for justice.
